Zimmerman’s children take the stand in defense of their father on trial for murder

After more than forty witnesses and 13 days of testimony, the prosecution rested in the murder trial of Kirk Zimmerman. As soon as the prosecution finished this morning, Zimmerman’s defense team asked the judge to take matters in his own hands, before the jury has a chance.
Defense attorney john rogers motioned for the acquittal of Kirk Zimmerman. Rogers argued for 15 minutes citing the lack of evidence provided by the state. He says the only physical evidence they have – gunshot residue in Zimmerman’s car – was planted or contaminated by Bloomington detectives.

Rogers said, “We heard days, if not weeks of testimony that resulted in zero evidence implicating Kirk Zimmerman.” Brad Rigdon responded for the State saying, “In the initial interview it’s obvious he was trying to hide something.”

Judge Scott Drazewski denied the defense’s motion for a directed verdict– saying there is “clearly evidence that the defendant had the opportunity to commit the crime” and a clear motive. The defense brought in a flurry of witnesses after Judge Scott Drazewski denied their motion for a directed verdict due to a lack of evidence from the state. The defense wasted no time calling 14 witnesses to the stand after the prosecution rested this morning.

Many of the witnesses either worked in the same building as Pam Zimmerman or were neighbors of Kirk Zimmerman – testifying they saw nothing out of the ordinary when they left Pam’s office.. some say they even saw Kirk doing yard work the afternoon of Pam Zimmerman’s death. Two other witnesses testified to hearing gunshots in the area of 2103 E. Washington Street on the night of Pam’s death. But the timing of their testimony didn’t match up with one hearing three shots around 5:30 and the other hearing one shot around 7.

The last two witnesses of the day were Heidi and David Zimmerman, two of Pam and Kirk’s three kids. They asked the court not to be shown on camera. They both said their dad was his normal self in the time leading up to their mom’s death. Heidi Zimmerman testified that two days after their mom was shot, Scott Baldwin, their moms boyfriend at the time, approached her and her siblings and said quote “i want you to know i had nothing to do with this.”

The defense has at least two more witnesses to testify tomorrow with closing arguments expected Thursday or Friday.
